Twenty-one, no exceptions

You must be 21 or older to buy from Above Wines, LLC or Grappolo Wine Shop, in person or online. The site asks you to confirm it once and remembers the answer in your browser for a year; if you tell us you are under 21, the storefront closes and stays closed. An adult 21 or older must be there, and must sign, for every delivery, and we may ask for photo identification at the shop, at a pickup, or at the door. We refuse any sale, and cancel any order, where age cannot be verified — with a full refund of anything paid.

Licensing and compliance

Above Wines, LLC holds the applicable permits issued by the Texas Alcoholic Beverage Commission and sells alcoholic beverages only as those permits allow. All sales are made, and title passes, in Texas. We ship only where we are licensed to ship — today that is Texas and California; our Shipping policy has the detail. We may limit quantities and decline any order we believe would breach TABC rules or any other law.

Your order, and when it becomes a sale

Placing an order is an offer to buy. The sale is made when we accept it, which is when we charge you and set the wine aside. Until then we may decline it — for age, for destination, for stock, or for an obvious error in a listing — and you pay nothing.

Prices, taxes and card costs

Prices are in U.S. dollars. Texas sales tax is added at checkout at the rate for the location your order is fulfilled from, and is shown to you before you pay. All posted prices include a 3.99% card-processing cost. Customers paying with cash receive that 3.99% back as a discount at the register. Prices can change without notice: wine is an agricultural product, vintages roll and allocations end.

Errors in a listing

If a listing carries an obvious error — a wrong price, a wrong vintage, stock we no longer have — we may cancel the affected order and refund it in full. That refund is the limit of what we owe for the mistake.

Getting it to you

Shipping, local delivery and pickup — what they cost, how fast they are, and where we can send wine — are set out in our Shipping policy, which is part of these terms. Orders over $199 ship free within the states we are licensed to ship to.

Returns and refunds

A flawed, corked or damaged bottle is always put right. What we can take back beyond that, and how a refund is paid, is set out in our Returns policy, which is part of these terms.

The wine club

A membership ships on the cadence of the tier you chose and is charged per shipment, not up front. There is no minimum sign-up period. You can skip your next shipment yourself from your account page at any time before it goes out, and undo the skip just as easily; we email you a confirmation with both dates on it. To change tier or to cancel, write to us — [ALDO: notice to cancel or change tier — 7 days before a shipment, 14 days, or any time before it ships?] — and we will confirm it in writing.

Wholesale accounts

Trade pricing is for approved accounts only. We approve an account against a valid resale certificate, and each account gets its own payment terms — COD, Net 15, Net 30 or Net 45 — which are recorded on the account and shown in the portal. Trade prices, price lists and statements are confidential to that account and are not to be republished.

Your account

We sign you in with a link emailed to your address, so whoever controls that mailbox controls the account. Keep it secure, and tell us if you lose control of it. We may suspend an account used to break these terms or the law.

What is ours

The words, photographs, video and design on this site belong to Above Wines, LLC or to the producers who licensed them to us, and are not yours to reuse commercially. Producer names and labels belong to the producers.

Limitation of liability

To the fullest extent permitted by law, Above Wines, LLC’s total liability arising from any order or from use of this site is limited to the amount you paid for the products at issue, and we are not liable for indirect, incidental or consequential damages. Nothing here limits liability that cannot be limited under applicable law. Please enjoy responsibly.

Governing law and venue

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts sitting in [ALDO: venue county — Dallas County, where the courts are, or another county?], Texas.
